Terms of Service

These Terms of Service ("Terms") govern access to and use of the PlayIQ website, applications, and related software platforms.
PlayIQ is operated from British Columbia, Canada.
By creating an account, accessing the application, or purchasing a subscription, you agree to these Terms on behalf of yourself or the entity you represent.
1. Eligibility & Minors
Adults may register and enter into these Terms directly.
A person under the age of majority in their jurisdiction (19 in British Columbia) may use PlayIQ only with verifiable authorization from a parent, legal guardian, or an authorized sports organization. Children under 13 may not independently register an account. Parents or guardians who authorize minor access agree to supervise their usage and assume legal responsibility for compliance with these Terms.
2. Description of Service
PlayIQ provides a cloud-based software suite for youth sports organizations, enabling practice planning, drill assignments, team roster management, media distribution, communication, and AI-assisted coaching assistance. Available capabilities vary based on account role, subscription level, and organizational permissions.
3. Account Security & Responsibilities
Users must provide accurate registration information and safeguard account credentials. Account sharing across unauthorized personnel is strictly prohibited. PlayIQ must be notified immediately at support@playiq.ca if account compromise is suspected.
4. Organization Accounts & Administration
Clubs, academies, and organizations using PlayIQ are responsible for managing access roles, maintaining active roster accuracy, revoking access for departing personnel, and obtaining all mandatory legal and parental consents prior to uploading player information.
Where an organization executes a separate enterprise agreement or Master Services Agreement with PlayIQ, that agreement controls in the event of a direct conflict with these Terms.
5. Acceptable Use & Youth Safeguarding
Users agree not to:
- Upload sexually explicit, abusive, harassing, defamatory, or harmful materials.
- Solicit, harass, or make unauthorized personal contact with minors.
- Input sensitive medical, health, or psychological records without explicit legal entitlement.
- Reverse engineer, scrape, decompile, or attempt to extract source code from PlayIQ software.
- Bypass usage caps, seat allocations, or security controls.
- Submit prompts to AI features that attempt to generate unsafe, unethical, or non-compliant content.
PlayIQ support is not an emergency response or child protective service. Immediate safeguarding risks must be reported directly to local law enforcement and sports governing bodies.
6. Plans, Seats, and Usage Capacity
PlayIQ limits capabilities based on purchased plan allocations (e.g., active coach seats, active player roster spots, storage, AI parsing usage).
- Active Coach Seat: A coach user assigned active access within the club system. Deactivated coaches may be replaced without incurring additional seat charges.
- Active Player Spot: A player assigned to an active team or active season roster. Archived alumni and historical player records do not count against active player limits.
Accounts exceeding usage limits may be restricted from issuing new team invitations, uploading additional media, or utilizing AI features until upgraded.
7. Free Trials & Subscriptions
Eligible subscriptions may include a free trial period. Unless explicitly stated during checkout, trial setups do not require credit card submission and will not automatically roll over into paid subscriptions without user action.
Paid subscriptions auto-renew continuously on a monthly or annual basis until explicitly cancelled via the PlayIQ billing portal. All charges are in Canadian Dollars (CAD) unless specified otherwise.
8. Price Changes
PlayIQ may change prices prospectively. For an existing self-service subscription, we will provide at least 30 days' notice before a price change affects a renewal, unless a shorter period is required to address a tax or legal change. Organization and enterprise pricing will be governed by the applicable order form.
Continuing a subscription after the notified renewal date constitutes acceptance of the new price. Customers may cancel before renewal.
9. Cancellation & Refund Policy
Subscriptions can be cancelled at any time prior to the next billing cycle via account settings. Cancellation stops future auto-renewal; service remains active through the end of the current paid billing period.
Fees paid are non-refundable, and no partial or pro-rated refunds are provided for unused portions of a billing period. Billing disputes must be submitted to support@playiq.ca within 14 days of charge occurrence.
10. Customer Content & Proprietary Rights
- Customer Ownership: Customers retain all ownership rights to practice plans, rosters, videos, images, and drill text uploaded to PlayIQ ("Customer Content").
- Operational License: Customers grant PlayIQ a non-exclusive, worldwide, royalty-free license to host, parse, cache, display, and process Customer Content solely to deliver, maintain, protect, and improve PlayIQ services.
- Aggregated Data: PlayIQ may generate anonymized, de-identified metrics to evaluate system performance and platform usage.
- AI Model Safeguard: PlayIQ will not use identifiable player records, youth video content, or Customer Content to train external general-purpose AI models without explicit separate authorization.
11. Organization Data, Export and Deletion
Organization administrators may request an export of reasonably available organization data.
Following cancellation or termination, data availability and deletion follow the retention schedule in the PlayIQ Privacy Policy and any applicable organization agreement. Customers are responsible for exporting information they are legally or operationally required to retain before the applicable deletion period expires.
PlayIQ may retain limited information where required for billing, security, legal compliance, or dispute resolution.
12. PlayIQ Intellectual Property
PlayIQ and its licensors own all software, platform architecture, user interfaces, branding, visual design, and proprietary drill formats, excluding Customer Content.
PlayIQ and related logos are trademarks owned or claimed by PlayIQ (CIPO Application No. 2487899). Un-authorized reproduction or distribution is strictly prohibited.
13. AI Disclaimer & Athletic Safety Limitations
- AI Output Notice: AI features provide automated suggestions as supplementary tools. AI outputs may contain inaccuracies and do not constitute certified athletic training, medical, or sports-science advice.
- Coach Judgment & Physical Safety: Coaches and organization staff retain sole responsibility for supervising physical activities, verifying drill age-appropriateness, managing training loads, evaluating field hazards, and ensuring player safety during training sessions.
- Usage Allowances: AI usage allowances, overages, and restrictions depend on the applicable plan or add-on.
- Sensitive Information: Users must not submit unnecessary personal or sensitive information to AI features.
14. Third-Party Services
PlayIQ depends on third-party services such as cloud hosting, authentication, payment processing, analytics, messaging, app stores, and artificial intelligence providers. Third-party services may be governed by their own terms and privacy policies.
PlayIQ is not responsible for an external service outside PlayIQ's reasonable control, but this does not limit responsibilities that cannot legally be excluded.
15. Feedback
If a user provides suggestions or product feedback, PlayIQ may use that feedback without restriction or compensation, provided PlayIQ does not publicly identify the contributor without permission.
16. Disclaimers
To the maximum extent permitted by law, PlayIQ is provided "as is" and "as available." PlayIQ disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, except where such warranties cannot legally be excluded.
PlayIQ does not guarantee:
- Specific athletic or player-development outcomes.
- Selection, recruitment, or scholarship results.
- That AI-generated content will be correct.
- That uploaded content will never be lost.
- Continuous, uninterrupted availability.
Coaches and organizations remain responsible for player safety, supervision, and the professional judgment used in training.
17. Limitation of Liability
To the maximum extent permitted under British Columbia and Canadian law:
- PlayIQ disclaims all liability for athletic injuries, physical harm, indirect, consequential, special, or punitive damages resulting from platform usage.
- PlayIQ's total cumulative financial liability under these Terms is strictly limited to the greater of (a) the fees paid by the customer to PlayIQ in the 12 months preceding the claim, or (b) CAD $100.
These exclusions and this cap do not apply to the extent liability results from fraud, wilful misconduct, gross negligence, or another matter for which liability cannot legally be limited.
18. Indemnification
Adult users and organizations agree to defend, indemnify, and hold harmless PlayIQ, its directors, and employees against third-party claims, damages, or liabilities arising from unauthorized upload of content, violation of youth privacy laws, or breach of these Terms. This obligation does not apply to minor players.
19. Suspension and Termination
PlayIQ may suspend or restrict access where reasonably necessary to address a security risk, prevent harm or unlawful activity, protect youth users, respond to non-payment, enforce capacity limits, investigate a suspected violation, or comply with law.
Where reasonably possible, PlayIQ will provide notice and an opportunity to correct the issue before terminating a paid account. Immediate suspension or termination may occur for serious security, safeguarding, abuse, or legal concerns.
Users may delete their accounts through available account controls or by following the Delete Account instructions. Termination does not eliminate payment obligations accrued before termination.
20. Service Changes and Availability
PlayIQ may improve, modify, or discontinue features. For material changes that substantially reduce core paid functionality, PlayIQ will provide reasonable notice where practicable.
PlayIQ does not guarantee uninterrupted or error-free operation. Maintenance, provider failures, internet conditions, security incidents, and events outside PlayIQ's reasonable control may affect availability. Any service levels expressly promised to an enterprise customer will appear in the applicable organization agreement.
21. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. All legal proceedings arising under these Terms shall be submitted exclusively to the jurisdiction of the courts located in British Columbia, Canada.
22. Changes to These Terms
PlayIQ may update these Terms to reflect changes to the service, law, security requirements, or business operations. For material changes, PlayIQ will provide at least 30 days' notice through the service or by email where reasonably practicable.
Changes apply prospectively. If a user does not accept a material change, the user may stop using PlayIQ and cancel before the change takes effect. Organization agreements may specify a different amendment process.
23. General Terms
If part of these Terms is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.
Users may not assign these Terms without PlayIQ's consent. PlayIQ may assign them as part of a merger, financing, reorganization, or sale of its business, subject to applicable privacy and legal obligations.
These Terms, the Privacy Policy, the applicable checkout terms, and any organization agreement constitute the applicable agreement between the parties.
